    Don't smokers have rights too?

    There's just something about people who run for office. Many lust to lord it over people. We've heard the phrase, "nanny state" for years. But as the busybodies pass more rules, America is becoming more like a "bully state." Politically unpopular folk are pushed around by those who are intoxicated with their power.

    This week my city banned smoking in parks and beaches. That's what Bill O'Reilly wants to talk about tonight.
    I selfishly like the law, because I don't smoke. But an outdoor ban based on fear of secondhand smoke? That's nonsense.

    Dozens of studies have searched for a connection between secondhand smoke and lung cancer or heart disease. Most found none. A few found a small relationship, but only in people who lived with smokers. They were exposed to smoke every day -- for years -- in homes and cars. To jump from that to assume that whiffs of smoke on a beach are harmful is silly.

    But that doesn't stop the authoritarians.

    More than 500 municipalities now ban smoking outdoors. St. Louis threatens smokers with a $1000 fine and up to 90 days in jail. I couldn't find examples of them actually enforcing that.

    Don't smokers have rights too? Banning smoking in public is the tyranny of the majority.

    Still, there's a better case to be made for outdoor smoking bans than previous bans on smoking in restaurants and bars. Parks and beaches are public property. Most of the public prefers a smoke-free environment. Bans on smoking in public are similar to laws against excessive noise.

    But a smoker who owns a bar ought to be allowed to smoke in his own bar. He should be free to let smokers congregate in that bar. If you don't like the smell, don't go there! Don't we have freedom of association in America? Especially on private property?

    Apparently not. More than 600 municipalities now ban smoking in restaurants and bars.

    You smokers are wimps. A few of you have banded together to fight this assault on your freedom, but most of you just let the state walk over you.
